Presentation of the event<\/h1>

The Council of the Notariats of the European Union and the European Commission are jointly organising a conference in Brussels on the two new European regulations on matrimonial property regimes and the property consequences of registered partnerships. The event will bring together more than 250 participants, notaries and representatives of the political, legal and academic worlds. Prestigious speakers honour the participants with their presence and will contribute to making the conference an event an event not to be missed in the legal news.<\/p> <\/div><\/div>[\/vc_column][\/vc_row][vc_row][vc_column]

STRENGTHENING LEGAL CERTAINTY FOR INTERNATIONAL COUPLES\u2026<\/h1>

Europe today has several million international couples, often facing legal uncertainty and additional costs when they have to share their assets in the event of separation or death. At present, it can be very difficult for them to know which courts have jurisdiction and which laws apply to their situation and property. The rules are very different from one country to another and sometimes generate conflicts, which are the source of financial costs. With the adoption in 2016 of two European regulations, the EU has equipped itself with the means to bring more legal certainty to these couples.<\/p> <\/div><\/div>[\/vc_column][\/vc_row][vc_row bg_type=”image” bg_image=”936″ pattern_overlay=”yes” color_overlay=”dark” opacity_overlay=”70″ footer_feature=”yes” padding_top=”4%” padding_bottom=”4%” font_color=”#ffffff”][vc_column font_color=”#ffffff”]

\u2026THANKS TO A NEW EUROPEAN LEGAL FRAMEWORK<\/span><\/span><\/h1>[vc_row_inner][vc_column_inner width=”1\/2″][vc_column_text]Regulations (EU) 2016\/1103 and (EU) 2016\/1104 will enter into force on 29 January 2019, as part of enhanced cooperation involving 18 Member States: Austria, Belgium, Bulgaria, Croatia, the Czech Republic, Cyprus, Finland, France, Germany, Greece, Italy, Luxembourg, Malta, the Netherlands, Portugal, Slovenia, Spain and Sweden.<\/span><\/span><\/p>\n

[\/vc_column_text][\/vc_column_inner][vc_column_inner width=”1\/2″][vc_column_text]The conflict of laws rules will now be unified between these Member States, thus usefully complementing Regulation (EU) 650\/2012 on international successions. For example, for a Franco-German couple living in Brussels, the provisions of the regulations will allow them to choose between the law of their habitual residence (Belgian law) or that of their nationality (French or German law), thus guaranteeing them greater predictability and therefore legal certainty.<\/span><\/span><\/p>\n
